Terms of service
In effect from 15 August 2026. We will post any change here and, where the change is material, tell account holders by email before it takes effect.
The agreement
These Terms are a binding agreement between Afterthought Feedback Services Pvt. Ltd.(“ATFS”, “we”) and the organisation whose people use the ATFS survey platform (“you”, “Customer”). You accept them by creating an account, by signing in, or by using the service.
If you are accepting on behalf of an organisation, you confirm you are authorised to bind it. If you are not, do not create the account.
Our Privacy Policy and DPDP disclosure form part of this agreement.
Definitions
- Service
- The ATFS survey platform, its APIs, its offline collection app, and the documentation we publish for them.
- Customer Data
- Everything you put into the Service or collect through it: survey definitions, respondent answers, uploaded files, and the analyses derived from them.
- Authorised User
- A person you permit to sign in under your account — an employee, a contractor, or a field surveyor.
- Respondent
- A person who answers one of your surveys.
Accounts and access
- You are responsible for everything done under your account, including by your Authorised Users, and for keeping credentials confidential.
- Accounts are for people aged 18 and over. Do not create an account for anyone younger.
- One person, one login. Sharing a single account between people defeats the audit trail you may later need to rely on.
- Tell us at once if you believe an account has been compromised, so we can revoke its sessions.
The number of Authorised Users, active surveys and monthly responses available to you is set by your plan. We will tell you when you are near a limit rather than cutting you off without warning.
Plans, fees and taxes
- The Starter plan is free and stays free. It is not a trial that expires.
- Paid plans are billed in advance, per month, in Indian rupees. Prices shown on the upgrade page include GST unless stated otherwise.
- Payments are processed by Razorpay. We never see or store your card details.
- You can cancel at any time. Cancellation stops the next renewal; it does not refund the current period, and your data stays available for the remainder of it.
- We may change prices with at least 30 days' notice by email. A change never applies to a period you have already paid for.
Reward points shown in the Service have no cash value and cannot be redeemed for money. Cash redemption is not offered and no part of this agreement should be read as promising it.
Acceptable use
You will not use the Service to:
- Collect personal data without a lawful basis, or beyond what the survey's stated purpose needs.
- Send unsolicited bulk invitations, or contact people who have asked you to stop.
- Survey anyone under 18 without verifiable consent from their parent or guardian, as § 9 of the DPDP Act requires.
- Upload malware, attempt to breach isolation between tenants, probe or load-test our infrastructure without written permission, or circumvent rate limits.
- Impersonate another organisation, or misrepresent who is collecting the data and why.
- Break any law that applies to you, or infringe anyone's intellectual property.
Automated access through our API is welcome within the documented rate limits. Scraping the web interface is not a supported substitute for it.
Your data stays yours
Customer Data belongs to you. We claim no ownership of it and acquire no licence to it beyond the narrow one we need to run the Service for you: to host it, transmit it, back it up, and display it to your own Authorised Users.
- We do not sell Customer Data.
- We do not use one customer's data to build products, benchmarks or models for anyone else.
- You can export your data at any time, in CSV, Excel or SPSS, for as long as your account is open.
Where Customer Data contains personal data, you are the Data Fiduciary and we are your Data Processor. We process it only on your documented instructions, and the terms of that arrangement are set out in the DPDP disclosure.
You are responsible for the lawfulness of what you collect: for giving respondents the notice the DPDP Act requires, for obtaining their consent, and for honouring the rights they exercise against you. The Service gives you the tools; it cannot make those judgements for you.
Availability and support
We aim to keep the Service available continuously and publish its current state at Service status. Planned maintenance is announced in advance and scheduled outside Indian business hours wherever we can.
Enterprise plans carry a contractual availability commitment recorded in the order form. Starter and Pro plans are provided without one. Offline collection is designed so that a network outage — ours or yours — does not lose a response.
Support is by email at support@snsurveys.com. Response targets depend on your plan.
Confidentiality
Each of us may learn confidential information about the other. Each will protect the other’s confidential information with at least the care it uses for its own, will use it only for this agreement, and will disclose it only to people who need it and are bound to keep it confidential. This does not cover information that is public through no fault of the receiver, was already known, is independently developed, or must be disclosed by law.
Intellectual property
The Service, its software, its design and the ATFS name remain ours. Nothing here transfers them to you. You get a non-exclusive, non-transferable right to use the Service during your subscription, and nothing more.
If you send us feedback, we may act on it without owing you anything. We will not identify you as its source without your permission.
Warranties and disclaimers
We warrant that we will provide the Service with reasonable skill and care, and that we will not materially reduce its core functionality during a period you have paid for.
Beyond that, and to the extent the law allows, the Service is provided as it is. We do not warrant that it will be uninterrupted or error-free, and we make no promise about the conclusions you draw from your data. Analyses and AI-generated summaries are aids to judgement, not substitutes for it, and should be checked before anyone relies on them.
Limitation of liability
Neither of us is liable to the other for indirect, incidental, special or consequential loss, or for lost profits, revenue, goodwill or anticipated savings, however caused.
Each party’s total aggregate liability arising out of this agreement is limited to the fees you paid us in the twelve months before the event giving rise to the claim. For a Starter plan account, which pays nothing, that figure is nil.
Nothing in this agreement limits liability for fraud, for wilful misconduct, for death or personal injury caused by negligence, or for anything else that cannot be limited under Indian law.
Indemnity
You will defend and indemnify us against claims brought by a third party arising from Customer Data or from your use of the Service in breach of these Terms — including a claim by a respondent that you collected their personal data unlawfully. We will tell you promptly about any such claim and let you control the defence, and we will not settle it without your agreement.
Suspension and termination
You may close your account at any time. We may suspend an account without notice where we reasonably believe it is being used to break the law, to attack the Service, or to endanger other customers’ data — and we will tell you why as soon as we safely can.
Either of us may terminate for material breach that is not fixed within 30 days of written notice.
After termination your data remains available for export for 30 days. After that it is deleted on the schedule described in the Privacy Policy. Ask us before the 30 days are up if you need longer.
Changes to these terms
This version is in effect from 15 August 2026. We may update these Terms; when we do, we will post the new version here and email account holders at least 30 days before a material change takes effect. Continuing to use the Service after that date means you accept it. If you do not, you may terminate and we will refund the unused part of any prepaid period.
Governing law and disputes
This agreement is governed by the laws of India. The courts having jurisdiction over our registered office in India have exclusive jurisdiction over any dispute arising out of it.
Before starting proceedings, both of us agree to try to resolve the dispute by talking: write to legal@snsurveys.com and we will respond within 14 days.
General
- If any clause is held unenforceable, the rest stays in force.
- Failing to enforce a clause is not a waiver of it.
- You may not assign this agreement without our written consent; we may assign it to a successor of our business.
- Neither of us is liable for failure caused by events genuinely beyond our control.
- These Terms, with the Privacy Policy and DPDP disclosure, are the whole agreement between us and replace anything said before.
